This Act derives from the Unfair Commercial Practices Directive 2005/29/EC and became law in Ireland in 2007. It is one of the most important pieces of Irish consumer legislation. It created a national enforcement body and provides added protections against unfair, misleading or aggressive commercial practices. It also sets requirements for price display, price controls, pyramid schemes and codes of practice. Under the Act, it is an offence for any trader to make a false or misleading claim about products, services, and prices. It is also an offence to sell products that show a false or misleading description. It bans traders from using aggressive tactics to influence a consumer's decision to buy. There are also 32 commercial practices that are prohibited. Compliance can be evidence through relevant policies and procedures, quality practices within an organisation and controls to ensure products and/or services provided reflect requirements, appropriate staff training and awareness on selling practices, documented records.
