This Act is the the primary piece of legislation governing water pollution. It is unlawful to cause or permit any polluting matter to enter waters. "Polluting matter" is defined widely by reference to the effect that substance may have on the receiving environment, including:
The quality of the water itself.
Injury to fish.
Injury to public health
.Injury to domestic, commercial, industrial, agricultural or recreational use.
Environmental Protection Agency-granted Integrated Pollution Control, Industrial Emissions and waste licences can have water emission limits included in their terms and the licence holder must comply with these emission limit values (ELVs). If the relevant licence does not contain such ELVs, the licence holder is bound by the Water Pollution Acts like all non-licenced sites and activities.
Local authorities issue separate Effluent Discharge Licences for lower grade activities. Sewer discharges are also licensed by local authorities.
Parties that engage in water abstraction activities are subject to reporting obligations. The EPA maintains a register of water abstractions. Those who abstract the daily maximum volume of 25 cubic meters (25,000 litres) or more must register this with the EPA.
A suitable flow meter shall be put in place at an appropriate position to record the daily volume of treated effluent discharged from a wastewater treatment plant.
