The Air Quality Standards Regulations (Northern Ireland) 2010 provide exemptions for certain types of monitoring stations from the evidence requirements. For example, monitoring at a station that is only intended to provide background levels of air quality, and not to determine compliance with the set standards, may be exempted. Similarly, where a station is located in an area where the population is low or there is no sensitive receptor, monitoring may be exempted. In addition, if the monitoring data is considered to be unreliable due to technical or operational issues, it may be excluded from the evidence used to determine compliance. However, where monitoring is exempted, local authorities must provide an explanation as to why the monitoring has been excluded and demonstrate that the exemption is justified. These exemptions allow for a more targeted approach to monitoring air quality, while still ensuring that compliance with the standards is adequately assessed.
